Terms of Service

These Terms of Service ("Terms") govern your access to and use of sinced ("the Service"), operated by Abdullah Gültepe, an individual based in Sweden ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old to use sinced. By using the Service, you confirm that you meet this requirement.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering. Notify us immediately at [email protected] if you believe your account has been compromised.

3. License to Use

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable license to access and use sinced for your own personal, non-commercial purposes. You may not copy, modify, distribute, sell, sublicense, reverse-engineer, or attempt to extract the source code of the Service, except to the extent permitted by applicable law.

4. Acceptable Use

You agree not to use sinced to:

• Upload or share content that is illegal, abusive, defamatory, or infringes third-party rights
• Attempt to gain unauthorised access to other users' data or our systems
• Use the Service for any commercial purpose without our written consent
• Interfere with or disrupt the integrity or performance of the Service

5. User Content

You retain full ownership of the content you create and upload on sinced (moments, notes, photos). By uploading content, you grant us a limited, non-exclusive licence to store and display it solely for the purpose of providing the Service to you. We do not claim ownership of your content and will not use it for any other purpose.

6. Subscriptions and Payments

sinced offers an optional paid "Premium" subscription with additional features, available on a monthly or yearly basis at the prices shown in the app at the time of purchase.

• Merchant of Record. Payments are processed by Paddle.com, which acts as the Merchant of Record (reseller) for all purchases. Paddle handles billing, payment, applicable taxes, and invoicing. Your purchase is also subject to Paddle's Buyer Terms.
• Free trial. New accounts may receive a time-limited free trial of Premium features. No payment is taken during the trial; you are only charged if you choose to subscribe.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price, unless cancelled before the renewal date.
• Cancellation. You can cancel at any time from your profile or via the Paddle receipt link. After cancelling, you keep Premium access until the end of the period you have already paid for; it is not renewed afterwards.
• Refunds. All sales are final and subscription fees are non-refundable, except where a refund is required by applicable law (for example, the EU/EEA right of withdrawal for consumers, where applicable) or is granted by Paddle at its discretion under its Buyer Terms. • Price changes. We may change subscription prices from time to time. Any change will apply only to future billing periods, and we will give you reasonable notice before it takes effect.

7. Third-Party Services

The Service relies on third-party providers to operate, including Paddle (payments and Merchant of Record) and our hosting and infrastructure providers. Your use of features powered by these providers may be subject to their own terms and privacy policies. We are not responsible for the acts, omissions, or content of third-party services, and any disputes relating to payment processing are subject to Paddle's Buyer Terms.

8. Service Availability

sinced is provided on a best-effort basis. We do not guarantee uninterrupted availability and reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice where possible.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice in serious cases. You may delete your account at any time from your account settings page, which will permanently remove all your data.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We are not responsible for any loss of data, missed reminders, or damages arising from your use of the Service.

11. Limitation of Liability

To the fullest extent permitted by law, sinced shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless sinced and its operator from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, or your violation of these Terms or of any applicable law or third-party rights.

13. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be subject to the exclusive jurisdiction of the Swedish courts.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via the app or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
